Agreement to Terms

By downloading, installing, or using SnapStat ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

SnapStat is operated by GiddyupGenie LLC ("we", "our", or "us").

Description of Service

SnapStat is a mobile application designed to help high school football coaches and athletic staff track game statistics in real-time. The App provides:

  • Play-by-play game tracking
  • Offline functionality with cloud sync
  • Statistical analysis and reporting
  • Data export capabilities (PDF, CSV)
  • Player performance portals

Account Registration

Requirements

  • You must be at least 13 years old to create an account
  • If you are between 13 and 17 years old, you must have parental or guardian consent
  • You must provide accurate and complete registration information
  • You are responsible for maintaining the security of your account credentials
  • You must notify us immediately of any unauthorized access

Account Responsibilities

  • You are responsible for all activities under your account
  • You may not share your account with others
  • You may not create multiple accounts for fraudulent purposes

Acceptable Use

Permitted Uses

  • Tracking legitimate high school football statistics
  • Managing team rosters and schedules
  • Generating reports for coaching purposes
  • Sharing player statistics with authorized individuals

Prohibited Uses

You may not:

  • Use the App for any illegal purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the App's functionality
  • Upload malicious code or content
  • Impersonate others or provide false information
  • Use the App in violation of any applicable laws
  • Scrape or harvest data from the App
  • Resell or redistribute the App without authorization

Subscription and Payments

Free Trial

New users receive a limited free trial (1 game) to evaluate the App before purchasing a subscription.

Subscription Plans

SnapStat offers an annual subscription purchased through Apple's App Store:

  • First Year: $179.00 per year
  • Renewal: $129.00 per year (auto-renews annually)
  • Coverage: One subscription covers unlimited teams within the same school/program
  • Team Access: Includes the coach plus unlimited parents and volunteers per team

Cancellation

  • You may cancel your subscription at any time through your Apple App Store account settings
  • Cancellation takes effect at the end of the current billing period
  • You will retain access to all features until the end of your paid period

Refunds

Refunds are handled by Apple per their App Store refund policy. Please contact Apple Support for refund requests.

Intellectual Property

Our Rights

  • The App, including its code, design, and content, is owned by GiddyupGenie LLC
  • Our trademarks and logos may not be used without permission
  • The App is protected by copyright and other intellectual property laws

Your Rights

  • You (or your team/organization) retain ownership of the data you enter
  • Team data is transferable between coaches
  • You grant us a license to store, process, and display your data to provide the service
  • You may export your data at any time in CSV or PDF formats

Data and Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Key points:

  • Your data is stored securely in the cloud (Supabase) and locally on your device (SQLite)
  • Data syncs automatically when online using PowerSync
  • You control sharing through portal links and exports
  • Team data is owned by the team and transferable between coaches

FERPA Disclaimer

SnapStat is a voluntary tool for tracking football statistics. Data entered into SnapStat is not an official school record and is not maintained by the educational institution. Users are responsible for ensuring compliance with their school district's policies regarding student data. SnapStat is not subject to FERPA as we are not an educational institution and do not maintain official educational records.

Disclaimers

Service Availability

  • The App is provided "as is" and "as available"
  • We do not guarantee uninterrupted or error-free service
  • We may modify or discontinue features with reasonable notice

Accuracy of Statistics

  • Statistical calculations are based on data you enter
  • We do not verify the accuracy of entered data
  • You are responsible for reviewing outputs for accuracy

NO WARRANTY: TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • We are not liable for indirect, incidental, special, or consequential damages
  • Our total liability is limited to the amount you paid for the App in the past 12 months
  • We are not liable for data loss due to device failure or user error

Indemnification

You agree to indemnify and hold harmless GiddyupGenie LLC and its affiliates from any claims, damages, or expenses arising from your violation of these Terms, your use of the App, or your violation of any third-party rights.

Termination

By You

You may stop using the App and delete your account at any time through the App settings.

By Us

We may suspend or terminate your account if:

  • You violate these Terms
  • You engage in fraudulent activity
  • Required by law
  • We discontinue the service

Effect of Termination

  • Your right to use the App ceases immediately
  • You may export your data before account deletion
  • After subscription lapse, data is retained for 90 days, then permanently deleted
  • After account deletion, data is permanently removed within 30 days

Changes to Terms

We may modify these Terms at any time. We will provide notice of significant changes through in-app notifications, email to your registered address, and updated "Last Updated" date. Continued use after changes constitutes acceptance of the new Terms.

Dispute Resolution

Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.

Arbitration

Any disputes will be resolved through binding arbitration in accordance with the American Arbitration Association rules, except where prohibited by law.

Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in class actions.

General Provisions

  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and GiddyupGenie LLC
  • Severability: If any provision is found unenforceable, the remaining provisions remain in effect
  • No Waiver: Our failure to enforce any right does not waive that right
  • Assignment: You may not assign these Terms. We may assign our rights without restriction

Apple App Store Additional Terms

When using the App downloaded from Apple's App Store:

  • Apple is not responsible for the App or its content
  • Apple has no obligation to provide maintenance or support
  • Apple is not responsible for addressing any claims about the App
  • Apple is a third-party beneficiary of these Terms
